Agreement to Terms
By accessing or using ArmoredGate services ("Services"), including Voltainer, ArmoredContainers, and ArmoredForge, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use our Services.
These Terms apply to all users, including visitors, registered users, and customers. We may update these Terms at any time, and your continued use constitutes acceptance of any changes.
Description of Services
ArmoredGate provides container infrastructure services including:
- Voltainer: A lightweight container runtime using systemd-nspawn
- ArmoredContainers: Managed container orchestration and deployment platform
- ArmoredForge: Container image conversion and optimization service
Service features, availability, and pricing may change. We will provide reasonable notice of material changes that affect your use of paid services.
Account Registration
To access certain features, you must create an account. You agree to:
- Provide accurate and complete registration information
- Maintain the security of your account credentials
- Promptly notify us of any unauthorized access
- Accept responsibility for all activities under your account
We reserve the right to suspend or terminate accounts that violate these Terms or for any other reason at our discretion.
Acceptable Use
You agree to use our Services only for lawful purposes. You may not:
- Violate any applicable laws or regulations
- Infringe on intellectual property rights of others
- Distribute malware, viruses, or malicious code
- Attempt to gain unauthorized access to our systems
- Use Services for cryptocurrency mining without authorization
- Engage in activities that disrupt or overload our infrastructure
- Resell Services without our written consent
- Host content that is illegal, harmful, or violates third-party rights
We may suspend or terminate access immediately if we reasonably believe you have violated these terms.
Your Content and Data
You retain ownership of all content and data you upload to our Services ("Your Content"). By using our Services, you grant us a limited license to host, store, and process Your Content solely to provide the Services.
You are responsible for:
- Ensuring you have rights to use and distribute Your Content
- Maintaining backups of Your Content
- Compliance with applicable data protection laws
We do not monitor or access Your Content except as necessary to provide Services, respond to support requests, or comply with legal obligations.
Payment Terms
Paid services are billed according to your selected plan. You agree to:
- Pay all fees when due as specified in your plan
- Provide valid payment information
- Accept automatic billing for subscription services
Fees are non-refundable except as required by law or explicitly stated in your service agreement. We may suspend services for non-payment after reasonable notice.
Service Availability
We strive to maintain high availability but do not guarantee uninterrupted service. We may temporarily suspend Services for:
- Scheduled maintenance (with reasonable advance notice)
- Emergency repairs or security updates
- Circumstances beyond our reasonable control
Specific uptime commitments may be provided in separate Service Level Agreements (SLAs) for enterprise customers.
Intellectual Property
ArmoredGate and its licensors retain all rights to our Services, including software, documentation, trademarks, and other intellectual property. These Terms grant you a limited, non-exclusive license to use our Services as intended.
You may not copy, modify, reverse engineer, or create derivative works from our Services except as expressly permitted.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- Our Services are provided "AS IS" without warranties of any kind
- We disclaim all implied warranties including merchantability and fitness for a particular purpose
- We are not liable for indirect, incidental, consequential, or punitive damages
- Our total liability shall not exceed the amounts paid by you in the 12 months preceding the claim
Some jurisdictions do not allow limitation of certain warranties or damages, so these limitations may not apply to you.
Indemnification
You agree to indemnify and hold harmless ArmoredGate, its affiliates, and their respective officers, employees, and agents from any claims, damages, or expenses arising from:
- Your use of the Services
- Your Content
- Your violation of these Terms
- Your violation of any third-party rights
Termination
You may terminate your account at any time through your account settings or by contacting us. We may terminate or suspend your access:
- For violation of these Terms
- For non-payment of fees
- If required by law
- For any reason with 30 days' notice
Upon termination, your right to use Services ceases immediately. We will provide reasonable opportunity to export Your Content before deletion.
Dispute Resolution
Any disputes arising from these Terms shall be governed by the laws of the State of Delaware, USA, without regard to conflict of law principles. You agree to resolve disputes through binding arbitration, except for claims that may be brought in small claims court.
You waive any right to participate in class action lawsuits or class-wide arbitration.
General Provisions
- Entire Agreement: These Terms constitute the entire agreement between you and ArmoredGate
- Severability: If any provision is found unenforceable, the remaining provisions continue in effect
- Waiver: Failure to enforce any right does not waive that right
- Assignment: You may not assign these Terms without our consent
